Loaner Probe Agreement

Unisyn Medical Technologies is pleased to provide loaner probes to customers as part of our ultrasound probe test and repair service. By accepting and using loaner probes, the customer agrees to the set of terms and conditions outlined in this Loaner Probe Agreement.

Upon receipt of a Unisyn loaner probe, the customer acknowledges that all service personnel, sonographers, and clinicians that will use the probe are familiar with the proper use, storage, and cleaning of the probe and further the customer acknowledges their understanding and agreement that any damage that occurs to the loaner probe during the loaner period is the financial responsibility of the customer. Failure to follow the care and cleaning instructions included with the loaner probe will render the customer responsible for any repair or replacement costs incurred. The customer agrees to pay for any repair service parts and/or labor that are the result of probe use outside of the ordinary or as a result of customer abuse or accident. Unisyn retains the right to determine abuse to a loaner probe.

By accepting the loaner probe, the customer agrees to the payment terms and conditions quoted to the customer and/or outlined in an invoice for the repair or replacement of a probe damaged, lost or stolen while under the care of the customer. The customer agrees to send their repair probe to Unisyn within 5 (five) days of receiving the loaner probe and to make a decision regarding the recommendations within 5 (five) days of receiving the evaluation. The customer agrees to return the loaner probe within 5 (five) days of receiving the repaired probe or after receiving notice from Unisyn that the customer’s probe is not repairable. Failure to send the repair probe, take action regarding the recommendations or return loaner probe within the allotted time will subject the customer to rental fees of $150 per day. The customer agrees to purchase probes not returned after 30 days at the current list price unless otherwise agreed to in writing by Unisyn.

The customer freely accepts and fully assumes all risk and hazards associated with the use of the equipment and shall hold Unisyn harmless for any liability or loss of income that may occur as a result of the rental equipment. Unisyn is responsible for repair of any damage to the customer’s equipment resulting from a loaner probe and is responsible for repair of damage that is a result of the normal operation of the loaner probe. Packing/Shipping:
Unisyn ships probes to customers in validated packaging material. Please retain the original Unisyn probe packaging and use this packaging or an equivalent to return loaner probes to Unisyn. Ultrasound transducers should be packaged in such a way as to protect the connector, connector pins, and the lens/scanhead. Securely wrapping or holding each of these subassemblies in a bubble-wrap or foam material or using boxes and foam packaging specifically designed for ultrasound probes can typically accomplish this. Shipments of assemblies for repair or defective assemblies for exchange should be shipped using an airfreight shipping company such as Airborne Express, Federal Express, DHL, or United Parcel Service (UPS). An airline or other shipping method will result in delays in shipping and much higher costs. Probes should be returned to:

Care:

  • Do not use the transducer for any other purpose other than its intended use.
  • Do not drop the transducer on a hard surface.
  • Do not use the transducer if there are any cracks in the case.
  • Do not use the transducer if the cable jacket or bend relief is damaged.
  • Do not allow the transducer cable to be draped near the system wheels.
  • Do not gas or heat sterilize the probe.
  • Do not use any types of oil with the transducer.
  • Do not use disinfectants that are based on phenols, alcohol or organic solvents.
  • Only use biopsy needle guides that are approved for a given probe model type and ensure that probe users have direct experience with the needle guide to be used with any Unisyn loaner probe.
  • Only use water-based coupling gels recommended by the probe manufacturer.
  • Only use cleaning methods recommended by the probe manufacturer.
  • Inspect probe lens, cable and housing before each patient exam.
  • Always use probe covers for endocavity, intra-operative and biopsy procedures.
  • Always use TEE bite guards on TEE probes to avoid damage caused by patient bitemarks.
  • Test TEE probes for excess leakage current after every procedure. Test endocavity probes for excess leakage current every 3 months. Test general probes for excess leakage current every 6 months.
  • Use probe as manufacturer recommends.

Cleaning:
NOTE: The transducer cannot be submerged in any liquid beyond the bend relief on the connector or the control housing on TEE probes.

  • After every patient exam, wipe the transducer gel off the transducer with a moist cloth.
  • Dry the transducer with a clean towel to remove any excess moisture.
  • Disinfect the transducer per manufacturer instructions.
  • When not in use, the transducer may be stored in the shipping box provided.
  • The probe should be stored at a temperature of –5˚C to 43˚C (23˚F to 109˚F).
